Introduction
These Terms and Conditions (“Terms”) govern your access to and use of StudyCreds (the “Website”). By accessing our website, booking a consultation, or using any of our services, you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree, you must discontinue use of our services immediately.
StudyCreds Limited is the operator of the Website. We are a limited company registered in England and Wales (Company Number: 16463079). Our registered office is at Unit 3, Halegrove Court, Cygnet Drive, Stockton-On-Tees, United Kingdom, TS18 3DB.
1. General
1.1 StudyCreds Ltd (“we”, “us” or “our”) acts as an education-loan facilitation and advisory platform that connects study-abroad aspirants with banks, NBFCs, financial institutions, and related service providers
1.2 StudyCreds is an advisory platform offering guidance on education loans to students pursuing education opportunities abroad. We operate through physical offices, online platforms, phone consultations, and partner networks.
1.3 We do NOT provide loans, do not act as a lender, guarantor, or credit-granting entity, and do not issue binding loan approvals. We act solely as an education loan advisory and facilitation service provider.
1.4 Any loan agreement is solely between the User and the Partner Institution. The Company is not a party to such agreements.
1.5 Unless the context clearly indicates to the contrary, wherever you see an apparently Inappropriate Use of Capital Letters, the words or phrases concerned are defined for the purposes of these Terms as follows:
1.5.1 Website / Company / We / Us - StudyCreds
1.5.2 Student / Client / User / You - Any person using StudyCreds services
1.5.3 Partner Institutions / Service Providers - Partner banks, NBFCs, financial institutions, or vendors assisting in service delivery.
1.5.4 Services - Counselling, university applications, visa guidance, accommodation referrals, scholarship assistance, pre-departure support, and related services
1.5.5 Personal Data means any information capable of identifying an individual directly or indirectly.
1.5.6 Sensitive Personal Data includes financial records, identification documents, and credit-related information.
1.5.7 Information means any Personal Data and Sensitive Personal Data as collected by the Company.
1.5.8 Processing includes collection, recording, storage, transfer, analysis, or deletion of personal data.
1.5.9 Services refer to the services of the Company sought by any person.
2. Our Services
2.1 StudyCreds provides guidance and additional services for the application process of education loans. These Services include, but are not limited to:
2.1.1 Securing Educational Loans with Collateral
2.1.2 Loans for Short-term Courses
2.1.3 Verifying Student Eligibility for Educational Loans
2.1.4 Interest Rate Analysis for Education Loans
2.1.5 Securing Education Loans without Collateral
2.1.6 Expert Guidance for Choosing Education Loans
2.1.7 Custom EMI Calculator for Education Loans
2.2 StudyCreds provides counselling, loan-comparison tools, document-assistance services, and introductions to Partner Institutions.
2.3 StudyCreds may assist in preparing loan applications but does not guarantee loan approval, interest rates, loan amount, processing timelines, visa approval or application success. Final decisions are made solely by Partner Institutions.
3. User Eligibility
3.1 Users must be legally capable of entering into binding agreements.
3.2 Students under 18 must obtain written consent from a parent or legal guardian.
3.3 Uscholars reserves the right to refuse services where eligibility requirements are not met.
4. User Representations and Warranties
4.1 You represent and warrant that:
4.1.1 All documents submitted are genuine and valid.
4.1.2 You will not misrepresent income, identity, or academic records.
4.1.3 You will comply with applicable laws and lender requirements.
4.1.4 You will not use the Website for fraud, unlawful solicitation, or money-laundering.
4.2 Providing false information may result in termination and legal action.
5. Third Party Services
5.1 Users acknowledge that lenders, credit bureaus, KYC agencies, and service vendors are independent entities.
5.2 StudyCreds is not responsible for loan rejections, loan terms, hidden charges by lenders, service delays by third parties or disputes between users and lenders.
5.3 Users are encouraged to view lender agreements carefully.
5.4 The Website may contain links to or content provided by third parties. The Company does not control such content, does not endorse third-party views, and assumes no liability for inaccuracies, omissions, defamatory material, or unlawful content contained therein. Any reliance on third-party information is at the User’s own risk.
6. Credit Checks and KYC Consent
6.1 By using the Services, you authorise StudyCreds and Partner Institutions to conduct credit checks, verify identity documents, perform background verification and access information from credit bureaus or regulatory authorities.
6.2 These checks are necessary to verify identity, assess creditworthiness, and determine loan eligibility in accordance with applicable regulatory and lender requirements.
7. Intellectual Property
7.1 All the intellectual property rights in StudyCreds, including all the services offered on the Website, are owned or controlled by StudyCreds Ltd.
7.2 All the intellectual property rights in Partner institution descriptions and images are owned or controlled by the relevant institution or someone authorised by them, either of whom has licensed those intellectual property rights to us for the purpose of delivering our services via the Website.
7.3 You are not permitted to edit, copy, duplicate or save any of the images or extracts found on this Website.
8. Limitation of Liability
8.1 To the fullest extent permitted by law, StudyCreds shall not be liable for any direct, indirect, incidental, or consequential loss incurred by users.
8.2 You acknowledge that you access and use the Website of StudyCreds voluntarily and entirely at your own risk.
8.3 You further agree that:
8.3.1 You are solely responsible for evaluating the suitability of any loan product, lender, or financial arrangement.
8.3.2 You will exercise independent judgment and prudence before entering into any transaction with Partner Institutions or third parties.
8.3.3 The Company shall not be liable for any actions, omissions, decisions, or conduct of any lender, partner institution, or user.
8.3.4 The Company shall not be liable for any indirect, incidental, special, punitive, or consequential damages of any kind, including but not limited to loss of data, loss of income, business interruption, emotional distress or reputational harm, regardless of whether such damages were foreseeable.
8.4 The Company expressly disclaims all responsibility arising from interactions between users and third parties.
8.5 Under no circumstances shall the Company be liable for any loss of business, profits, revenue, contracts, anticipated savings, opportunity, goodwill, reputation, or wasted expenditure, whether direct or indirect, arising from:
8.5.1 Loan rejection or approval decisions
8.5.2 Loan terms, interest rates, or charges
8.5.3 Delays in processing by lenders
8.5.4 Visa refusal or admission outcomes
8.5.5 Use or inability to use the Website
8.6 Most of the information you find on this Website regarding Partner Institutions are as provided by our Partner Institutions. Consequently, we cannot state categorically whether any information you find is either accurate or up to date, and you should not rely on anything you find on the Website without checking it first.
8.7 Although we monitor what is published on the Website, we shall not be liable for any possible false or misleading information that has been published on it, nor shall we be liable for any loss or damage caused by your use of the Website.
8.8 These limitations of liability should not be interpreted as excluding or limiting in any way our liability for death or personal injury resulting from our negligence or for fraud or for any other issue for which it would be unlawful for us to exclude or limit our liability.
9. Data Protection
9.1 We shall comply at all times with all the provisions and obligations imposed by the Data Protection Act 1998 (“the Act”) when storing and processing Personal Data. You confirm that we may use your Personal Data (including Personal Data defined by the Act as “sensitive personal data”) for the purposes of delivering our services to you and for making or arranging your Booking with the Accommodation Provider.
9.2 Any Personal Data stored by us about you is available on request, but there may be a fee payable.
9.3 We collect personal information to provide our services. By using our services, you consent to data collection, storage, and sharing with partner institutions for application processing.
9.4 We implement reasonable safeguards to protect data, but cannot guarantee absolute security. Please review our Privacy Policy for detailed information.
10. Marketing Consent
10.1 By submitting enquiries or registering with us, you consent to receiving communications via email, phone, SMS, or WhatsApp related to study abroad services, events, and updates. You may opt out at any time.
11. Termination of Services
11.1 StudyCreds may terminate services immediately if:
11.1.1 False documents are submitted
11.1.2 User attempts fraud
11.1.3 Misconduct or abuse occurs
11.1.4 Legal or ethical concerns arise
11.2 Students may discontinue services at any time, but consultancy fees or previously agreed paid services remain non‑refundable.
11.3 Upon termination, your right to use Services ceases immediately.
12. Force Majeure
12.1 StudyCreds shall not be liable for failure or delay due to events beyond our control, including pandemics, embassy closures, strikes, government policy changes, natural disasters, war, or travel restrictions.
13. Severance
13.1 If a court finds any part of these Terms illegal, the rest will continue in force. Each clause of these Terms will operate separately, unless specifically mentioned in the Terms, subject to such changes as a presiding court may deem appropriate in order to achieve the clearly intended purpose of the said clause.
14. Assignment
14.1 We may assign our agreement with you (including all our obligations to you) at any time, and if we do so, we will inform you by email of that assignment and the third party to whom we have assigned our agreement with you.
14.2 You may not assign your agreement with us to any third party at any time save with our express consent, and should you attempt to do so, we may accept your purported assignment as a material breach of these Terms for which we may be entitled to terminate our agreement with you (including all further obligations as yet unfulfilled) with immediate effect.
15. Variation
15.1 We may change these Terms from time to time at our discretion, and when we do so, we will notify you in advance of the change as soon as it is reasonably practicable for us to do so.
15.2 StudyCreds reserves the right to update these Terms at any time. Continued use of our services constitutes acceptance of revised Terms.
16. Termination
16.1 We may terminate our agreement with you on written notice with immediate effect at any time should you enter into any form of insolvency process, including personal bankruptcy or any voluntary arrangement with your creditors.
16.2 We may terminate our agreement with you on written notice with immediate effect at any time, should we suspect that you are a participant in any kind of fraud or that you intend to use our Services for which it is not intended.
16.3 Should we terminate our agreement with you, we shall be relieved of all further obligation towards you in respect of the services to which this agreement relates. These terms shall remain in force notwithstanding our termination of the agreement.
17. Complaints and Dispute Resolution
17.1 Complaints must be submitted in writing to our official email. We aim to respond within 7 working days.
17.2 Any dispute shall first be attempted to be resolved amicably. If unresolved, disputes shall be subject to the jurisdiction stated below.
18. Law and Jurisdiction
18.1 These terms and conditions are subject to the laws of England and Wales.
18.2 Any legal action or claim arising out of these terms and conditions shall be the subject of exclusive jurisdiction of the English courts.
